Terms of Service

1. Acceptance of Terms

By registering for, attending, or participating in the Blagaj Climbing Fest 2025 ("Festival"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not participate in the Festival.

These Terms constitute a legally binding agreement between you and the Festival organizers. Your participation in any Festival activity constitutes acceptance of these Terms.

2. Assumption of Risk and Liability Waiver

Inherent Risks

You acknowledge that participation in the Festival involves inherent and significant risks, including but not limited to:

  • Rock Climbing: Falls, equipment failure, rockfall, cuts, bruises, fractures, paralysis, or death
  • Highlining/Slacklining: Falls from height, serious injury, paralysis, or death
  • Outdoor Activities: Weather conditions, terrain hazards, getting lost, dehydration, hypothermia
  • Group Activities: Actions of other participants, overcrowding, collisions
  • Transportation: Vehicle accidents, road conditions, mechanical failures
  • Accommodation: Fire, theft, injury at camping sites or lodging facilities
  • Medical: Limited access to medical care, delayed emergency response

Voluntary Participation

You voluntarily choose to participate in these activities with full knowledge of the risks involved. You understand that no amount of care, caution, instruction, or expertise can eliminate the inherent risks of these activities.

Release of Liability

To the fullest extent permitted by law, you hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE the Festival organizers, sponsors, volunteers, employees, agents, local partners, accommodation providers, activity leaders, and all other persons or entities associated with the Festival (collectively "Released Parties") from any and all liability, claims, demands, losses, or damages including death, personal injury, property damage, or loss arising from your participation in the Festival.

Indemnification

You agree to INDEMNIFY and HOLD HARMLESS the Released Parties from any loss, liability, damage, or costs they may incur arising from your participation in the Festival, including attorney's fees and court costs.

3. Safety Requirements and Personal Responsibility

Personal Safety Equipment

  • You are responsible for providing and maintaining your own climbing equipment
  • All equipment must meet international safety standards (CE, UIAA, or equivalent)
  • You must inspect your equipment before each use
  • Damaged or worn equipment must not be used

Skill Level and Experience

  • You must honestly assess your skill level and only participate in appropriate activities
  • Beginners must seek proper instruction and supervision
  • You must not attempt activities beyond your experience level
  • It is your responsibility to decline participation if you feel unsafe

Health and Fitness

  • You must be in adequate physical condition to participate safely
  • You must disclose any medical conditions that could affect your safety
  • You are responsible for bringing necessary medications
  • Alcohol and illegal drugs are prohibited during activities

Following Instructions

  • You must follow all safety instructions given by activity leaders
  • You must respect area closures and access restrictions
  • You must comply with local laws and regulations
  • Failure to follow safety rules may result in removal from activities
4. Registration and Payment Terms

Registration Requirements

  • You must be at least 16 years old to register independently
  • Participants under 18 require parental/guardian consent
  • You must provide accurate and complete registration information
  • Registration confirmation is required before participation

Payment and Refunds

  • Payment is made in cash at the registration point upon arrival at the festival
  • No advance payment is required - all fees are collected on-site
  • Cash payment in EUR or BAM (Bosnian Convertible Mark) is accepted
  • Cancellations must be notified at least 7 days before the Festival
  • No refunds for no-shows or late cancellations
  • Medical emergencies may be considered for refunds (documentation required)
  • Festival cancellation due to force majeure: Full refund provided

Pricing and Discounts

  • All prices are in Euros and include applicable taxes
  • Bosnia and Herzegovina residents eligible for 50% discount on multi-day packages
  • Discount eligibility verified through residency documentation
  • Group discounts available for 5+ participants from same organization
5. Code of Conduct

Expected Behavior

  • Treat all participants, staff, and locals with respect and courtesy
  • Respect the natural environment and Leave No Trace principles
  • Follow all safety guidelines and instructions
  • Respect cultural norms and local customs
  • Maintain appropriate noise levels, especially in camping areas
  • Keep common areas clean and organized

Prohibited Behavior

  • Harassment, discrimination, or intimidation of any kind
  • Excessive alcohol consumption or illegal drug use
  • Destruction of property or environmental damage
  • Climbing in closed areas or without proper authorization
  • Sharing or selling personal registration credentials
  • Commercial activities without organizer permission

Consequences

Violation of the code of conduct may result in immediate removal from the Festival without refund. Serious violations may be reported to local authorities. The Festival organizers reserve the right to determine what constitutes a violation and appropriate consequences.

6. Photography and Media

By participating in the Festival, you grant the organizers perpetual, royalty-free permission to use your name, voice, image, and likeness in photographs, videos, and other media for promotional, educational, or commercial purposes related to the Festival and future events.

If you do not wish to be photographed or filmed, you must inform the organizers in writing before the Festival begins. However, you acknowledge that in group settings, complete avoidance of photography may not be possible.

7. Intellectual Property

All content, materials, logos, and trademarks associated with the Festival are protected by intellectual property laws. You may not use, reproduce, or distribute any Festival materials without explicit written permission from the organizers.

8. Force Majeure and Event Changes

The Festival organizers reserve the right to modify, postpone, or cancel the Festival due to circumstances beyond our control, including:

  • Severe weather conditions or natural disasters
  • Government restrictions or public health emergencies
  • Safety concerns or access restrictions
  • Insufficient participation or other operational challenges

In case of cancellation, participants will receive a 90% refund. The organizers are not liable for any additional costs incurred by participants, including travel, accommodation, or other expenses.

9. Insurance and Medical Care

Personal Insurance

You are strongly advised to obtain comprehensive travel and activity insurance that covers:

  • Medical treatment and emergency evacuation
  • Adventure sports and climbing activities
  • Personal liability coverage
  • Trip cancellation and interruption
  • Personal equipment and belongings

Medical Care Limitations

Medical facilities in the area may be limited. The nearest hospital is approximately 30 minutes away. Emergency evacuation from remote climbing areas may be difficult and time-consuming. The Festival organizers are not responsible for the cost or availability of medical care.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Bosnia and Herzegovina. Any disputes arising from these Terms or your participation in the Festival shall be resolved through binding arbitration in Mostar, Bosnia and Herzegovina, or through the competent courts of Bosnia and Herzegovina.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Incident Reporting

  • All accidents and incidents must be reported to Festival organizers immediately
  • Participants must cooperate with incident investigations
  • Written incident reports may be required
  • Serious incidents will be reported to appropriate authorities
12. Environmental Responsibility

The Festival is committed to environmental protection. All participants must follow Leave No Trace principles:

  • Pack out all trash and waste
  • Respect wildlife and vegetation
  • Use established trails and climbing routes
  • Minimize campfire impact
  • Respect other visitors and the quiet of nature
  • Plan ahead and prepare to minimize environmental impact
